To falsely advertise as a FENSA registered company is an offence under the Trade Marks Act 1994 and Consumer Protection from Unfair Trading Regulations 2008.
Companies who are not registered with FENSA are not permitted to use the FENSA logo from their website, any company paperwork, stationery and advertising.
Installers who have been found to misuse the FENSA logo or otherwise mislead the public into believing them to be FENSA registered have been prosecuted and many fines have been issued in excess of £3000.
